1. SCOPE
1.1 The conditions below apply to the use of the website www.kicolabel.com as well as by e-mail and telephone for offers, deliveries, services and agreements concluded with Kico employees. Separate conditions are not recognized unless Kico expressly agrees to them in writing.
1.2 These conditions only bind and authorize the consumer. A consumer within the meaning of the regulation below is defined as any natural person who concludes an agreement for reasons that are predominantly not commercial or independent in nature. Consumers will hereinafter also be referred to as "customers".
2. PREFACE
2.1 Kico is a fashion brand and online shop. Kico sells woolen clothing and other woolen items.
2.2 Kico reserves the right to continuously update and adjust individual functionalities of its service, and to limit them if necessary.
2.3 Kico reserves the right to change these general terms and conditions at any time by removing, replacing or supplementing sections. Each order is subject to the terms and conditions valid from the date of entry into force, unless a mandatory change to these terms and conditions becomes unavoidable for legal or regulatory reasons (in which case the most recent version of the terms and conditions will also apply to orders that were placed before they came into effect).
3. REGISTRATION WITH KICO
3.1 To use Kico's internet services, it is necessary to register in Kico's online system. The customer must enter a valid email address and set a password upon registration. It is the sole responsibility of the customer to ensure that no rights of others are violated. The customer is obliged to treat his personal login details confidentially and to prevent unauthorized third parties from gaining access to this data.
3.2 Registration is free. There is no right to membership at Kico. Kico may impose additional requirements on registration (e.g. data control). The customer is obliged to provide the information provided correctly and in the correct form when registering. During an active membership with Kico, any changes to the information provided must be communicated without delay or request on the part of Kico. Regardless of successful registration, there is inherently no entitlement to use the services offered.
3.3 The customer is obliged to provide Kico with an e-mail address. Kico is entitled to send relevant statements for the customer to this email address, unless a more binding form of communication is legally or contractually established.
3.4 The customer gives Kico permission to contact him by telephone or via any other means of communication for the settlement of an agreement.
3.5 The customer is only authorized to use Kico's internet services via the usual programs (internet browsers) or possibly via software made available by Kico. Improper use is in particular access via automated software (e.g. scripted programs). This applies in particular if the software used is used to generate or retrieve specific data.
3.6 It is prohibited to copy or otherwise use content from Kico's web pages without prior permission from Kico.
4. CONTRACT AGREEMENT
4.1 An offer to purchase is made by the customer when sending an order by activating the relevant button. This offer is binding for the customer for four weeks. Kico reserves the right to reject customer offers without stating reasons
to refuse. Sending a confirmation by Kico does not imply acceptance of this purchase offer. It only serves as confirmation of receipt of the order. The offer will only be accepted by Kico when this acceptance has been communicated to the customer (via e-mail) or when Kico ships the items
4.2 Kico collects or uses probability values for the purpose of determining the cause, execution or termination of the contractual relationship that - among other things - uses address data.
5. DELIVERY AND RETURNS
5.1 Delivery of items generally takes place within 1 working day after Kico has accepted the customer's offer, i.e. from the moment the items are shipped or after confirmation of the order by e-mail. Kico currently supplies to most EU countries, as well as (via B2B) to the US and Canada. Kico strives to deliver to all countries, but countries outside the EU, US and Canada are subject to availability.
5.2 Kico uses various shipping companies.
5.3 Customers are asked to register a return via email. Kico only accepts returned items that are returned with original labels. If the customer wishes to exercise his right of withdrawal in accordance with paragraph 9 of these conditions and returns the items without original labels, he is legally obliged to reimburse Kico for the depreciation.
6. RESERVATION OF PROPRIETARY RIGHTS
Items shipped by Kico remain the property of Kico until the account balance has been fully settled.
7. PURCHASE PRICE AND PAYMENT METHOD
7.1 The prices stated at checkout in the webshop are final, including the relevant local VAT and other price components.
7.2 Kico offers the customer various payment methods. Before ordering, the customer can find all information about accepted payment methods on the website at any time. Kico reserves the right not to offer individual payment methods or only for certain orders.
7.3 All data-related operations (e.g. collection, processing and transfer) are carried out in accordance with legal regulations. Data relevant to business transactions is stored and passed on to service providers appointed by us when necessary for order processing.
7.4 Our basic prices are determined in euros. For your convenience, you can check out in your own currency. Please note: If you check out in USD, CAD, DKK or GBP, prices are automatically determined based on the latest exchange rates and may therefore fluctuate. In the event that you choose a refund, we can only refund you in Euros, which will then be converted into your currency.
8. WARRANTY AND LIMITATIONS OF LIABILITY
8.1 Warranty is given in accordance with the law on liability for defects.
8.2 The customer is not entitled to compensation. Excluded from this are claims regarding personal injury and life-threatening injuries, injuries to health or resulting from a violation of core elements of the contract (cardinal duty), as well as liabilities for other damages resulting from intentional or gross negligence by Kico, its statutory representatives or assistants. Core elements of the agreement are those elements that are relevant to achieving the purpose of the agreement.
8.3 In the event of a violation of core elements of the agreement, Kico is only liable for damage typical of the agreement and predictable in the event that it is caused by negligence, with the exception of claims of the customer based on injury to life, body or health.
8.4 The restrictions stated in paragraphs 8.2 and 8.3 also apply to Kico's legal representatives and vicarious agents, if claims are brought directly against them.
9. REFUNDS AND CANCELLATIONS
9.1 If you have returned items, the purchase price will be refunded via the same payment method you used when ordering. See below for more information. The purchase amount will be automatically refunded to your (credit card) account within 30 days.
9.2 It is always possible to exchange an item for a similar item or another product. Place a separate order at www.kicolabel.com for the replacement item. If you have any questions about an exchange or refund, please contact us at info@kicolabel.com.
10. DATA PROTECTION
The collection, processing and storage of data takes place exclusively in accordance with the guidelines of Dutch privacy legislation. For more information regarding customer consent and data collection, processing and use, please refer to the Privacy section which can be accessed at any time on Kico's website via the menu item 'Privacy Policy'.
11. TRANSFER OF RIGHTS AND OBLIGATIONS TO THIRD PARTIES
Kico is entitled to transfer all rights and obligations arising from the contract in whole or in part to third parties. In the event of such a complete or partial transfer of rights and obligations to a third party, the customer has the right to terminate the agreement at the time of transfer.
12. ASSIGNMENT OF CLAIMS TO THIRD PARTIES
The customer grants Kico permission to sell any outstanding debt to a third party for the purpose of collection ("Factoring").
13. FINAL PROVISION
13.1 Dutch law applies to agreements concluded between Kico and its customers, with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. In the case of contracts with consumers, this choice only applies to the extent that the protection offered by mandatory provisions of the law of the country where the consumer has his habitual residence is not withdrawn.
13.2 These terms and conditions will otherwise remain in force if individual members become non-binding. Legal provisions replace all existing ineffective paragraphs. If this causes an unreasonable disadvantage to one of the parties, the conditions will become invalid in their entirety.

14. PROMOTIONS, DISCOUNTS & OFFERS
From time to time we may run promotions that reduce the price of certain products.
If the promotion is activated by a discount code, the customer must enter the discount code at checkout. Each promotion, discount or offer has its own terms and conditions, which will be made clear at the time and place it is introduced, e.g. in an email, on the product pages, in a Facebook advert, etc.
If you receive a unique discount code just for you, keep it secret and don't let anyone else use or misuse it (for example, don't post it on social media).
If we notice fraud, tampering, technical errors or anything else beyond our control that affects the running or fairness of the promotion - we may cancel, modify or suspend the promotion.
Promotions, discount codes and offers can never be combined. Customers are entitled to use one offer/discount code/promotion per order.
Offers, promotions and discount codes are non-transferable, have no cash value and cannot be applied to previous purchases or the purchase of gift cards. We reserve the right to change or end a promotion at any time without notice.
